RSA in France: amount, 15 hours of activity and sanctions

The RSA now requires registration with France Travail and 15 hours of activity a week. The amount since 1 April 2026, conditions, exemptions, suspension of payment, overpayments and how to challenge a decision.

Since 2025, claiming the active solidarity income means registering with France Travail and signing a commitment contract. The first suspensions are landing, often without the claimant understanding why. A lawyer reviews your file in 20 minutes on Avocat20min.fr.

RSA: amount and conditions in 2026

The RSA guarantees a minimum income to people with no resources or with low resources. The full rate reaches €651.69 a month for a single person since 1 April 2026.

That amount then varies with the composition of the household, with increases for a partner and each dependent child. The family allowance fund also deducts a housing package where you own your home, are housed free of charge or receive a housing benefit.

Four conditions apply:

  • Being at least 25, unless you have a dependent child or sufficient prior work.
  • Living in France on a settled basis, meaning more than nine months a year.
  • Having resources below the flat-rate amount, assessed over the last three months.
  • For a non-European foreign national, holding a residence permit allowing work for five years, with exceptions for refugees and certain permits.

The 15 weekly hours of activity

The law of 18 December 2023 on full employment changed the logic of the benefit. Since 1 January 2025, registration with France Travail is automatic, and every claimant signs a commitment contract.

That contract provides for between 15 and 20 hours of activity a week. The term covers far more than paid work:

  • Job-search workshops and support appointments.
  • Training, including refresher courses and French lessons.
  • Work placements and periods of immersion in a company.
  • Integration steps, such as action on health, housing or transport.

Exemptions exist, and you have to ask for them. Your adviser may reduce or remove that volume on health grounds, for disability, for a single parent with no childcare solution, or where personal circumstances justify it.

Suspension of the RSA: the new scale

Failing to honour the commitment contract first leads to an interview, then to a partial or total suspension of payment. The president of the departmental council decides, on a proposal from France Travail.

Failing Usual consequence
Unjustified absence from an appointment Warning, then partial suspension
Refusal to draw up or update the contract Payment suspended
Repeated failings Suspension of 1 to 4 months
Established fraud Removal and recovery of the sums

The suspension-and-return mechanism softens the penalty. If you put your situation right, the suspended sums are paid to you retroactively, up to three monthly payments.

You also have the right to be heard before any decision. So always answer letters, even late, and keep proof of what you have done.

Overpayments: when the fund claims money back

An undeclared change of circumstances, a data-entry error or forgotten income creates an overpayment. The family allowance fund then recovers the sums from future benefits, within a percentage of your income.

Three levers exist against a claim:

  • Challenging the overpayment, where the calculation or the facts are wrong.
  • A discretionary debt write-off, granted on social grounds, except in cases of fraud.
  • Spreading the repayment, negotiated with the office.

Limitation also plays a part: two years to claim an RSA overpayment, five in cases of fraud. So check the periods covered before paying.

Challenging a decision

The RSA belongs to the department, not to the State. A challenge follows a precise path:

Stage Deadline Sent to
Compulsory prior administrative appeal 2 months President of the departmental council
Reply, or silence amounting to refusal 2 months Silence means refusal
Court claim 2 months Administrative court

This prior appeal is free and needs no lawyer. Give your reasons, attach the documents and expressly ask for payment to continue while the appeal is examined.

Interim relief finally allows a quick decision from the administrative judge where the cut-off threatens your situation. It requires proven urgency and serious doubt about the lawfulness of the decision.

When to consult a lawyer

A lawyer checks that the procedure was lawful, drafts the appeal and applies to the judge urgently where payment stops. They also obtain write-offs on old overpayments. A social security lawyer answers within 20 minutes. Removal from the France Travail register follows similar rules. The detail sits on service-public.gouv.fr.
