France Travail deregistration: grounds, sanctions and appeals
France Travail deregistration cuts the benefit, and the list of grounds has grown. The new scale of sanctions since June 2025, the right to be heard, the internal appeal, the ombudsman and the administrative court.
One missed appointment is sometimes enough to cut a benefit. Since June 2025 sanctions can be adjusted, but they also reach more situations than before. A lawyer reviews your file in 20 minutes on Avocat20min.fr.
France Travail deregistration: the statutory grounds
The Labour Code lists the failings exhaustively. In practice, six grounds come up most often:
- Missing an appointment or a summons, without a legitimate reason.
- Insufficient job search, assessed on the steps actually taken.
- Refusing two reasonable job offers, as defined in your personalised plan.
- Refusing to draw up or update the commitment contract.
- Refusing a training course or the support offered.
- False declaration, which carries the heaviest sanctions.
Every ground assumes the absence of a legitimate reason. Sick leave, a job interview, a transport problem or unexpected childcare all count, provided you report them and can prove them.
The scale of sanctions since June 2025
The decree of 30 May 2025 replaced fixed sanctions with adjustable durations, depending on the nature of the failing and any repetition. France Travail deregistration therefore no longer follows automatically.
| Failing | Usual sanction |
|---|---|
| First minor failing | Warning, or 15 days' suspension |
| Repeated absence | One month off the register and loss of the benefit |
| Repeated failings | Longer durations, up to 4 months |
| False declaration | Removal for 6 to 12 months |
Deregistration carries two separate effects. It removes you from the list of jobseekers, and it cuts the replacement income for the period set. The days lost are not recovered at the end of your entitlement.
Dialogue now comes before automatic action. France Travail must tell you which failing it alleges and let you present your observations before any decision.
The right to be heard
This lever weighs more than all the others, and yet few people use it. You have a period to answer in writing, usually ten days, before the adviser sends their proposed sanction.
Use it every time. Attach the sick note, the competing appointment, the employer's statement or the transport document. A documented explanation defeats a large share of proposed sanctions.
Then keep a copy of everything, along with the delivery receipts. A decision that skips this stage risks being quashed for procedural defect.
Challenging a France Travail deregistration
A challenge follows three routes, which can run one after the other.
| Route | Deadline | To whom |
|---|---|---|
| Prior appeal | 2 months | Director of the local office |
| Regional then national ombudsman | After the prior appeal | France Travail ombudsman |
| Court claim | 2 months after the confirmed decision | Administrative court |
The prior appeal comes before any judge. Draft it soberly: set out the facts, the date of the decision, the ground relied on, then the evidence you produce.
The ombudsman steps in where that first appeal fails. Their role has carried more weight since June 2025, and they regularly obtain reversals without going to court.
Before the administrative judge, interim relief finally allows a quick decision. It requires urgency, which you show by the absence of resources.
During the procedure: limiting the damage
Stay registered, or register again as soon as the sanction period ends. Registration governs access to training, to health cover and to several related rights.
Also check whether you qualify for other help. The RSA sometimes takes over, as does the specific solidarity allowance for people who have exhausted their entitlement.
Finally, update your situation every month, even without payment. A missed update ends your registration quite apart from any sanction.
Where the end of a contract is in dispute
A sanction sometimes lands on top of a dispute with an employer. An employee challenging a dismissal for serious misconduct keeps their rights, because the job loss remains involuntary.
Likewise, a resignation opens no rights, except where it counts as legitimate or where a retraining project has been approved. A reclassification obtained before the employment tribunal then opens the way to back payment.
When to consult a lawyer
A lawyer assesses whether the sanction is lawful, drafts the appeal and applies for interim relief when the money stops. They also align the file with any employment claim under way. A social security lawyer answers within 20 minutes. The rules sit on the France Travail website.
