Residence permit withdrawal in France: grounds and appeals
A residence permit withdrawal follows strict rules: public order, fraud, lost conditions, republican principles. Prior hearing, the residence commission, removal orders and appeals.
A letter from the prefecture says it intends to withdraw your residence card, sometimes with a removal order attached. Yet a residence permit withdrawal follows strict rules: the law sets precise grounds and a procedure. You can answer before any decision, then go to court. Residence permit withdrawal: what exactly is it?
Three decisions look alike. However, they follow different rules.
| Decision | When? | What it changes |
|---|---|---|
| Residence permit withdrawal | While the card is still valid | The card stops having effect before its expiry |
| Refusal to renew | At expiry, after your application | You lose your right to stay when the card ends |
| Repeal (abrogation) | At any time, for the future | A term used mostly for removal measures |
A residence permit withdrawal therefore happens while your card is valid. The prefecture acts on its own initiative, without waiting for any application. If it rejects your file at expiry instead, that is a refusal: our article on residence permit refusal covers that case.
The CESEDA, the French immigration code, sets these rules out in articles L.432-4 to L.432-12.
Grounds for a residence permit withdrawal
The list is closed. The prefecture must tie its decision to one of the grounds the law provides.
A threat to public order
This is the most common ground. Under article L.432-4 of the CESEDA, a temporary or multi-year card can go for a mere threat to public order. For a resident card or an "EU long-term resident" card, however, the threat must be serious.
The judge checks that the threat is current. He looks at the facts, how old they are and your conduct since. So an old, isolated conviction is not always enough.
Other articles target specific conduct:
- Forgery and use of forged documents (article L.432-5-1).
- Certain serious offences, such as drug trafficking, human trafficking or pimping (article L.432-6).
- Violence against an elected official or certain people holding public authority (article L.432-6-1).
A condition is no longer met
Article L.432-5 then allows a residence permit withdrawal if you no longer meet a condition for issue. For example, a spouse of a French national stops living with them. The same article also covers anyone who obstructs checks or ignores summonses.
One nuance protects employees, though: losing your job against your will does not count as a lost condition. Our article on residence permit obligations sets out your duties while the card is valid.
Fraud
A card obtained by fraud can go at any time, with no deadline. Article L.241-2 of the code on relations between the public and the administration (CRPA) says so for any administrative act. Typical cases: a sham marriage, a false acknowledgment of a child, forged payslips.
Work
Article L.432-7 targets a foreign national working without the required authorisation, and a foreign employer hiring undocumented workers. For students, article L.432-9 allows a residence permit withdrawal if they exceed 60 % of annual working time.
Polygamy
A resident card cannot go to a foreign national living in France in a polygamous union, nor to his spouses (article L.432-3). If the prefecture issued one anyway, article L.432-10 requires it to withdraw the card.
The republican commitment contract
Since 17 July 2024, every applicant signs a contract committing to respect the principles of the Republic (articles L.412-7 onwards). A breach can lead to a residence permit withdrawal. It must, however, meet three tests: the conduct is deliberate, serious and disturbs public order.
For a multi-year card or a resident card, the prefect weighs the seriousness, any repetition and how long you have lived in France. Refugees and beneficiaries of subsidiary protection stay better protected: such a breach is not enough on its own.
Separation after family reunification
A spouse who came through family reunification can lose the card if the couple splits up in the first years (article L.423-19). Domestic violence, however, rules out that sanction.
The procedure before any residence permit withdrawal
The prefecture cannot take you by surprise. Article L.121-1 of the CRPA requires a prior adversarial procedure, and article L.432-5 of the CESEDA refers to it expressly.
In practice, the prefecture writes to you first. It sets out the facts it relies on and gives you time to send written observations. You can also ask for a meeting, with the lawyer of your choice. Only urgency or exceptional circumstances allow it to skip this step.
Always reply, and in writing. Attach evidence of your integration: work, family, housing, references, compliance with any sentence. That letter then becomes a key document before the judge.
The residence permit commission
In some cases, the prefecture must first consult the residence permit commission (article L.432-13). For a withdrawal, two situations require it:
- After family reunification, in the case set out in article L.423-19.
- For a breach of republican principles, where it concerns a multi-year card or a resident card (article L.412-10).
You then receive a summons and may bring someone to assist you. If the prefecture skips the commission when it was compulsory, that procedural flaw can void the withdrawal.
Resident card: stronger protection
Holders of a resident card are better placed. First, the residence permit withdrawal here requires a serious threat to public order. A mere threat will not do.
Next, article L.432-12 bars the prefecture from issuing a removal order (OQTF) after that withdrawal. It must then consider expulsion, with its own safeguards. If you are protected against expulsion (articles L.631-2 and L.631-3), you receive temporary leave to remain as of right.
For other cards, the law of 26 January 2024 removed almost all protection against an OQTF, except for minors. A spouse or parent of a French national can therefore receive an OQTF after losing the card. Your family life nevertheless remains a strong argument in court, under article 8 of the European Convention on Human Rights.
Residence permit withdrawal and removal orders
Most of the time, the prefecture attaches an OQTF to its decision. Article L.611-1 of the CESEDA lists withdrawal of a permit as a ground for removal. The same order can also set the country of return and impose a re-entry ban.
That changes everything for deadlines. With an OQTF, the appeal period generally drops to one month, or even seven days or 48 hours. Our guide to the OQTF appeal sets out these deadlines. The one on the re-entry ban and the SIS explains the measure that often comes with it.
Challenging a residence permit withdrawal
Several routes exist. The right choice depends mainly on whether an OQTF comes with the decision.
| Route | Addressed to | Deadline | Effect |
|---|---|---|---|
| Informal appeal | The prefect | 2 months | Extends the court deadline, except with an OQTF |
| Hierarchical appeal | The Interior Minister | 2 months | Same effect, same limits |
| Court action | The administrative court | 2 months, or the OQTF deadline | The only route that can annul the decision |
| Interim suspension | The urgent applications judge | Alongside the main action | Can suspend the withdrawal within weeks |
Without an OQTF, you have two months to go to the administrative court. An informal appeal then remains useful. With an OQTF, by contrast, it extends nothing: go straight to the judge.
Interim suspension under article L.521-1 of the code of administrative justice needs two things: urgency and serious doubt about legality. For a residence permit withdrawal, the judge generally accepts urgency, since you lose work and social rights.
The court then reviews the procedure, the ground relied on and the proportionality of the measure. If it annuls the withdrawal, the prefecture must reconsider your situation.
After the decision: what to do
Without a valid permit, you lose the right to work and part of your social rights. So keep the decision, the envelope and proof of your appeals.
Do not miss other deadlines either. If your card expires during the procedure, apply in time: our article on residence permit renewal covers the deadlines and documents.
When to consult a lawyer
As soon as the letter announcing the adversarial procedure arrives. That is the best moment to prevent a residence permit withdrawal, before any decision. A lawyer drafts your observations, gathers evidence and prepares for the commission if needed. After the decision, he identifies the right deadline and brings the case to court. Depending on your income, legal aid can cover the fees.
A lawyer in immigration law answers you within 20 minutes. Articles L.432-4 to L.432-12 of the CESEDA are available on Légifrance.
