Employee to entrepreneur status change in France: which permit?
Leaving your job to start a company? An employee to entrepreneur status change requires the right permit: entrepreneur card, talent card, viability, minimum wage and timing.
You work in France on an "employee" card and want to start your own company? Your current permit does not cover that new activity. You therefore need to change status, at the right time and with a solid project. A lawyer reviews your file in 20 minutes on Avocat20min.fr.
Employee to entrepreneur status change: why it matters
The "employee" card allows salaried work. In principle, it does not cover self-employed work carried out as your main activity. Running your own company, invoicing clients or practising a liberal profession falls under another permit.
An employee to entrepreneur status change therefore means applying for a new permit, based on your project. You stay lawfully in France as long as your current card remains valid. However, you cannot launch the business full time before you hold the right document.
Owning shares in a company is generally not a problem. It is carrying on the self-employed activity that requires the right permit.
The permits available to start a company
For an employee to entrepreneur status change, two main permits are open to you. The choice depends on your degree, your experience and your capital.
| Permit | Key conditions | Duration | Legal basis |
|---|---|---|---|
| "Entrepreneur/liberal profession" card | Viable business, income at least equal to the minimum wage | 1 year, then a 4-year multi-year card | Article L.421-5 of the CESEDA |
| "Talent, project holder" card (business creation) | Master's degree or 5 years of experience, investment of at least €30,000, a real and serious project | Up to 4 years | Article L.421-16 of the CESEDA |
The "entrepreneur/liberal profession" card thus suits most projects. The "talent" card, which is more demanding, gives a long permit from the start.
The entrepreneur/liberal profession card
This card covers any commercial, craft, industrial or liberal activity. The activity must last more than three months and be your main occupation. You must also register it with the single business formalities portal. Our guide to setting up a company explains those steps.
Economic viability
The prefecture checks that your business is economically viable. It also requires income at least equal to the full-time minimum wage (SMIC), that is €1,867.02 gross a month since 1 June 2026.
Since spring 2026, a prior opinion on the viability of the project has been compulsory. An order of 13 May 2026, published in the Journal officiel on 16 May, lists the documents to provide. The list varies with your case: creation, takeover, joining an existing company or micro-business.
Documents that convince
A strong employee to entrepreneur status change file relies on concrete evidence:
- A costed forecast over two or three years, realistic and consistent.
- Proof of activity: signed quotes, letters of intent, first contracts.
- Funding: personal contribution, bank loan or investors.
- Your skills: degrees and experience in the same sector.
- The articles of association and the company registration extract.
High turnover, moreover, is not always enough. The prefecture mainly looks at the income you actually draw from it.
The talent card for business creation
Since the 2025 reform, this card carries the "talent, project holder" mention. It targets more qualified founders. You need a master's level degree, or five years of comparable professional experience. You must also invest at least €30,000 in the project.
The Ministry for the Economy then confirms that the project is real and serious, through a dedicated platform. Finally, your resources must reach at least the annual gross minimum wage, about €22,404.
This card lasts up to four years. It therefore avoids a first one-year card. Someone already living in France can apply for it through an employee to entrepreneur status change.
Your current permit makes all the difference
Your starting point changes everything. Some cards already allow you to start a company without any formality.
| Current permit | Do you need a status change? |
|---|---|
| One-year "employee" card | Yes, to the entrepreneur or talent card |
| Multi-year "employee" card | Yes, it remains tied to salaried work |
| "Talent, qualified employee" card | Yes, in principle |
| Ten-year resident card | No, any activity is open |
| "Private and family life" card | No, it allows self-employment |
The holder of a resident card can therefore start a company freely. They simply register the business, like a French national.
When to file your application
Timing is decisive. Most often, you file the employee to entrepreneur status change application when your "employee" card comes up for renewal. The useful window runs from four to two months before expiry.
A complete file lodged in time entitles you to a certificate of extended processing. It keeps your stay lawful while the application is examined. Our article on residence permit renewal explains that calendar.
Think about how you leave your job, too. A resignation does not, in principle, open unemployment benefits. A negotiated termination (rupture conventionnelle), in contrast, may give you benefits during the launch.
What does an employee to entrepreneur status change cost?
Since 1 May 2026, a first card costs €350 in principle: €300 of tax and €50 of stamp duty. A renewal costs €250. Filing late adds €180.
Then, after a year on the entrepreneur card, you can aim for the four-year multi-year card. It requires level A2 in French and a pass in the civic exam.
The mistakes that sink the project
Some errors come up again and again in employee to entrepreneur status change files.
- Launching the business too early: invoicing without the right permit exposes you to a refusal, or even a removal order.
- Leaving your job too fast: without income, viability becomes hard to prove.
- Submitting an unrealistic forecast: the prefecture compares your figures with the sector.
- Aiming for income below the minimum wage: refusal then becomes likely.
- Filing after expiry: you lose the extension certificate.
